{"id":269,"date":"2026-07-09T10:07:56","date_gmt":"2026-07-09T10:07:56","guid":{"rendered":"https:\/\/willi.giuuls.com\/general-terms-and-conditions\/"},"modified":"2026-08-20T09:47:16","modified_gmt":"2026-08-20T09:47:16","slug":"general-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/willi.giuuls.com\/en\/general-terms-and-conditions\/","title":{"rendered":"General terms and conditions"},"content":{"rendered":"<section class=\"legal\">\n    <div class=\"container\">\n        <div class=\"legal__inner\">\n            <header class=\"legal__head\">\n                                    <h1 class=\"legal__title\">General terms and conditions<\/h1>\n                                                    <p class=\"legal__updated\">Laatst bijgewerkt: 1 August 2026<\/p>\n                            <\/header>\n            <div class=\"legal__content\">\n                <div class=\"acf-innerblocks-container\">\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<\/div>\n                                    <div class=\"legal__legacy\"><p>In these General Rental Terms and Conditions, the following terms shall have the meanings set out below:<\/p>\n<h2>Article 1 \u2013 Definitions<\/h2>\n<p><strong>Lessor: <\/strong>Grandi Car Rental, or the legal entity entering into the rental agreement with the Lessee.<\/p>\n<p><strong>Lessee:<\/strong> the natural person or legal entity entering into a rental agreement with the Lessor and in whose name the reservation and\/or rental agreement is registered.<\/p>\n<p><strong>Driver: <\/strong>the Lessee and any other person who has been approved in advance by the Lessor in writing or digitally to drive the Vehicle.<\/p>\n<p>Vehicle: the passenger vehicle, pickup truck or other vehicle made available by the Lessor to the Lessee.<\/p>\n<p><strong>Rental Agreement: <\/strong>the agreement between the Lessor and the Lessee concerning the temporary use of the Vehicle in exchange for payment of the agreed rental price.<\/p>\n<p><strong>Rental Period: <\/strong>the period from the agreed time of delivery or making the Vehicle available until the agreed time of return.<\/p>\n<p><strong>Rental Price: <\/strong>the amount owed by the Lessee for the use of the Vehicle during the agreed Rental Period.<\/p>\n<p><strong>Deposit: <\/strong>the amount paid by the Lessee to the Lessor as security for compliance with the Lessee&#8217;s obligations under the Rental Agreement.<\/p>\n<p><strong>Excess: <\/strong>the amount that, depending on the selected insurance package, remains payable by the Lessee in the event of covered damage.<\/p>\n<p><strong>Damage: <\/strong>any damage, loss, disappearance, depreciation or technical defect affecting the Vehicle or any of its parts.<\/p>\n<h2>Article 2 \u2013 Applicability<\/h2>\n<p>1. These General Rental Terms and Conditions apply to all offers, reservations, Rental Agreements and use of Vehicles provided by the Lessor.<\/p>\n<p>2. By making a reservation, accepting a reservation, signing the Rental Agreement or taking receipt of the Vehicle, the Lessee declares that they have read these General Rental Terms and Conditions and agree to them.<\/p>\n<p>3. Deviations from these General Rental Terms and Conditions shall only be valid if confirmed in advance by the Lessor in writing or digitally.<\/p>\n<p>4. If a provision of the Rental Agreement differs from these General Rental Terms and Conditions, the specific provision in the Rental Agreement shall prevail insofar as it has expressly been agreed as a deviation.<\/p>\n<p>5. If one or more provisions of these terms and conditions prove to be invalid or unenforceable, the remaining provisions shall remain fully in force.<\/p>\n<h2>Article 3 \u2013 Reservation and Formation of the Rental Agreement<\/h2>\n<p>1. A reservation request submitted via the website, email, telephone, WhatsApp or another communication channel constitutes a request and does not automatically constitute a final reservation.<\/p>\n<p>2. The Lessor may accept or refuse a reservation request.<\/p>\n<p>3. After accepting the reservation request, the Lessee will, where applicable, receive a payment request for the full agreed Rental Price.<\/p>\n<p>4. The reservation becomes final once the full Rental Price has been received by the Lessor, unless otherwise agreed in writing or digitally.<\/p>\n<p>5. If payment is not received within the period specified by the Lessor, the Lessor is entitled to cancel the reservation and make the Vehicle available again.<\/p>\n<p>6. The final Rental Agreement is set out in the rental agreement and\/or reservation confirmation.<\/p>\n<p>7. The Rental Agreement includes, among other things, the rented Vehicle, the Rental Period, the Rental Price, the Deposit, the applicable insurance package and the Excess.<\/p>\n<h2>Article 4 \u2013 Age, Driving Licence and Drivers<\/h2>\n<p>1. The Lessee must be at least 21 years old, unless the Lessor has confirmed otherwise in advance in writing.<\/p>\n<p>2. The Lessee must hold, throughout the entire Rental Period, a valid driving licence authorising them to drive the relevant Vehicle.<\/p>\n<p>3. At the Lessor&#8217;s request, the Lessee must present a valid driving licence and valid identification document.<\/p>\n<p>4. Only Drivers who have been registered and approved in advance by the Lessor may drive the Vehicle.<\/p>\n<p>5. The Lessee is responsible for the acts and omissions of every Driver designated by the Lessee.<\/p>\n<p>6. If a person who is not registered as a Driver drives the Vehicle, this may affect the applicable insurance coverage and the Lessee may be held liable for any resulting damage.<\/p>\n<h2>Article 5 \u2013 Rental Price, Payment and Deposit<\/h2>\n<p>1. The Rental Price is the price stated in the reservation confirmation and\/or Rental Agreement.<\/p>\n<p>2. The full Rental Price must be paid before the Rental Period begins, unless otherwise agreed in writing.<\/p>\n<p>3. The Deposit must be paid no later than upon delivery of the Vehicle.<\/p>\n<p>4. The amount of the Deposit is stated in the Rental Agreement.<\/p>\n<p>5. The Deposit serves as security for compliance with the Lessee&#8217;s obligations.<\/p>\n<p>6. The Lessor is entitled to set off outstanding amounts against the Deposit, including but not limited to:<\/p>\n<ul>\n<li>damage;<\/li>\n<li>the applicable Excess;<\/li>\n<li>traffic and parking fines;<\/li>\n<li>fuel costs;<\/li>\n<li>cleaning costs;<\/li>\n<li>costs resulting from the loss of keys or documents;<\/li>\n<li>costs resulting from improper use;<\/li>\n<li>other amounts owed by the Lessee under the Rental Agreement.<\/li>\n<\/ul>\n<p>7. If, after the end of the Rental Period, there are no outstanding amounts or damage claims, the Deposit will be refunded within 7 to 12 business days.<\/p>\n<p>8. If costs still need to be determined after the Vehicle has been returned, the Lessor may retain all or part of the Deposit until these costs have been determined.<\/p>\n<h2>Article 6 \u2013 Rental Period, Pick-up and Return<\/h2>\n<p>1. The Rental Period is the period stated in the Rental Agreement or reservation confirmation.<\/p>\n<p>2. The Vehicle must be collected and returned at the agreed time and agreed location.<\/p>\n<p>3. Early return does not entitle the Lessee to a refund of rent already paid, unless otherwise agreed in writing.<\/p>\n<p>4. Extension of the Rental Period is only permitted after prior written or digital approval by the Lessor.<\/p>\n<p>5. Independently continuing to use the Vehicle for longer than the agreed period without the Lessor&#8217;s permission is not permitted.<\/p>\n<p>6. If the Lessee returns the Vehicle more than one hour after the agreed end time without prior permission, a surcharge of <strong>XCG 50<\/strong> may be charged.<\/p>\n<p>7. If the Vehicle is returned more than three hours late, an additional rental day may be charged.<\/p>\n<p>8. If the Lessee expects not to be able to return the Vehicle on time, the Lessee must inform the Lessor as soon as possible.<\/p>\n<p>9. The Lessor may charge additional costs for a late return if, as a result, the Vehicle cannot be delivered to a subsequent Lessee on time.<\/p>\n<h2>Article 7 \u2013 Obligations of the Lessee<\/h2>\n<p>1. The Lessee is obliged to use the Vehicle carefully and in accordance with its intended purpose.<\/p>\n<p>2. The Lessee must comply with the applicable traffic rules and other laws and regulations in Cura\u00e7ao.<\/p>\n<p>3. The Lessee must park the Vehicle carefully and take sufficient measures to prevent theft or damage as far as possible.<\/p>\n<p>4. The Lessee must keep the Vehicle in good condition throughout the Rental Period.<\/p>\n<p>5. The Lessee must immediately inform the Lessor of damage, defects, warning or malfunction messages and other circumstances that may affect the safe use of the Vehicle.<\/p>\n<p>6. Without the Lessor&#8217;s prior permission, the Lessee may not have repairs or technical work carried out on the Vehicle, except where immediate action is reasonably necessary to prevent danger or further damage.<\/p>\n<p>7. The Lessee must follow the Lessor&#8217;s instructions concerning the use and condition of the Vehicle.<\/p>\n<h2>Article 8 \u2013 Use of the Vehicle<\/h2>\n<p>The Vehicle may only be used for normal and careful private use.<\/p>\n<p>The Vehicle may not be:<\/p>\n<ol>\n<li>used for taxi, Uber, ride-sharing or other commercial transport services;<\/li>\n<li>used for driving lessons;<\/li>\n<li>used for races, competitions, speed tests or other forms of sporting driving;<\/li>\n<li>sublet or made available to third parties;<\/li>\n<li>used for criminal or other unlawful activities;<\/li>\n<li>used for towing or pulling, unless the Vehicle is expressly equipped for this purpose and the Lessor has granted permission;<\/li>\n<li>used to transport more persons than legally or technically permitted;<\/li>\n<li>used while under the influence of alcohol, drugs or medication that affects driving ability;<\/li>\n<li>used in a manner that unnecessarily damages or excessively burdens the Vehicle.<\/li>\n<\/ol>\n<h2>Article 9 \u2013 Prohibited Areas and Off-road Use<\/h2>\n<p>Off-road use of the Vehicle is prohibited.<\/p>\n<p>The Vehicle may not be used on beaches, sandy roads, unpaved roads, rough terrain or other roads and terrain for which the Vehicle is not suitable.<\/p>\n<p>This includes, among others, but is not limited to, areas and roads such as:<\/p>\n<ul>\n<li>St. Jorisbaai; <\/li>\n<li>Vlakte van Hato;<\/li>\n<li>Christoffelpark;<\/li>\n<li>Shete Boka;<\/li>\n<li>Boka Patrick;<\/li>\n<li>San Juan;<\/li>\n<li>Barber;<\/li>\n<li>other unpaved roads and terrain.<\/li>\n<\/ul>\n<p>4. If the Lessee nevertheless uses the Vehicle in prohibited areas, the Lessee is liable for all resulting damage and reasonable costs, including recovery, transport, repair and any loss-of-use costs.<\/p>\n<h2>Article 10 \u2013 Insurance and Excess<\/h2>\n<p>1. The Vehicle is insured in accordance with the applicable insurance policy of the Lessor.<\/p>\n<p>2. The basic insurance and any additional insurance are stated in the reservation confirmation and\/or Rental Agreement.<\/p>\n<p>3. The amount of the Excess depends on the selected insurance package.<\/p>\n<p>4. Insurance does not mean that every type of damage is automatically covered.<\/p>\n<p>5. The Lessee remains liable for damage that is not covered under the applicable insurance terms and conditions.<\/p>\n<p>6. To the extent permitted by law and contract, insurance coverage may wholly or partially lapse if damage is caused by, among other things:<\/p>\n<ul>\n<li>intent;<\/li>\n<li>deliberate recklessness or gross negligence;<\/li>\n<li>driving under the influence;<\/li>\n<li>unauthorised use;<\/li>\n<li>use by an unregistered Driver;<\/li>\n<li>off-road use;<\/li>\n<li>use in violation of these General Terms and Conditions;<\/li>\n<li>failure to report damage in a timely manner;<\/li>\n<li>failure to cooperate with the handling of a damage claim.<\/li>\n<\/ul>\n<p>7. If no insurance coverage applies, the Lessee may be liable for the full amount of the damage.<\/p>\n<h2>Article 11 \u2013 Damage and Accidents<\/h2>\n<p>1. Any damage, collision, theft, attempted theft or technical problem must be reported to the Lessor immediately.<\/p>\n<p>2. In the event of a traffic accident, the Lessee must:<\/p>\n<ul>\n<li>immediately contact the Lessor;<\/li>\n<li>contact the competent emergency services or police if necessary;<\/li>\n<li>take photographs and\/or videos of the situation and damage;<\/li>\n<li>record the details of involved third parties and witnesses;<\/li>\n<li>provide all relevant information to the Lessor;<\/li>\n<li>fully cooperate with the handling of the damage claim.<\/li>\n<\/ul>\n<p>The Lessee may not admit liability to third parties or promise compensation on behalf of the Lessor without the Lessor&#8217;s prior permission, unless this is necessary to comply with a legal obligation.<\/p>\n<p>4. The Lessee must not leave the Vehicle in a manner that could reasonably result in further damage or theft.<\/p>\n<p>5. Failure to report damage in a timely manner may affect insurance coverage and the Lessee&#8217;s liability.<\/p>\n<h2>Article 12 \u2013 Theft and Loss<\/h2>\n<p>1. Theft, misappropriation or loss of the Vehicle or any of its parts must be reported immediately to the Lessor and the police.<\/p>\n<p>2. The Lessee must fully cooperate with the investigation and handling of the theft.<\/p>\n<p>3. The Lessee must carefully safeguard keys, documents and other items necessary for the use of the Vehicle.<\/p>\n<p>4. If theft or loss results from intent, gross negligence or violation of these terms and conditions, the Lessee may be held liable for the resulting damage, to the extent permitted by law.<\/p>\n<h2>Article 13 \u2013 Breakdown, Technical Problems and Repairs<\/h2>\n<p>1. Grandi Car Rental does not provide a separate 24-hour breakdown or roadside assistance service.<\/p>\n<p>2. If a technical problem or defect occurs during the Rental Period, the Lessee must inform the Lessor by telephone or digitally as soon as possible.<\/p>\n<p>3. Without prior permission from the Lessor, the Lessee may not instruct a towing service, garage, mechanic or other third party to carry out work on the Vehicle, except where immediate action is reasonably necessary to prevent danger or further damage.<\/p>\n<p>4. If the Vehicle can no longer be used safely due to a technical defect, the Lessor determines how the Vehicle will be collected, transported, inspected or repaired.<\/p>\n<p>5. If necessary, the Lessor may collect the Vehicle itself or engage a third party designated by the Lessor.<\/p>\n<p>6. If the technical problem cannot be attributed to the Lessee, reasonable costs for repairing the technical defect shall be borne by the Lessor.<\/p>\n<p>7. Costs resulting from an act or omission of the Lessee shall be borne by the Lessee. These include, among other things: <\/p>\n<ul>\n<li>driving with an empty fuel tank;<\/li>\n<li>filling the Vehicle with the wrong fuel;<\/li>\n<li>loss or damage to keys;<\/li>\n<li>locking the keys inside the Vehicle;<\/li>\n<li>a flat battery due to improper use;<\/li>\n<li>tyre damage due to improper use;<\/li>\n<li>damage caused by off-road driving;<\/li>\n<li>damage caused by improper or careless use.<\/li>\n<\/ul>\n<p>Replacement transportation is not automatically guaranteed. If another Vehicle is available, the Lessor may, at its discretion, offer a replacement Vehicle. <\/p>\n<h2>Article 14 \u2013 Fuel<\/h2>\n<p>1. Unless otherwise agreed, the Vehicle is delivered with a full tank of fuel.<\/p>\n<p>2. The Lessee must return the Vehicle with a full tank.<\/p>\n<p>3. If the Vehicle is not returned with a full tank, the Lessor is entitled to charge for the missing fuel.<\/p>\n<p>4. In addition, an administration fee of <strong>XCG 50<\/strong> may be charged.<\/p>\n<p>5. If the Lessee fills the Vehicle with the wrong fuel, all reasonable costs of inspection, removal of the fuel, transport and repair shall be borne by the Lessee.<\/p>\n<h2>Article 15 \u2013 Fines, Penalties and Other Costs<\/h2>\n<p>1. All traffic fines, parking fines, administrative penalties, towing costs and other costs incurred during the Rental Period as a result of the Lessee&#8217;s actions shall be borne by the Lessee.<\/p>\n<p>2. The Lessor is entitled to pass such amounts on to the Lessee, including reasonable administration costs.<\/p>\n<p>3. To the extent permitted, the following fixed charges may be applied:<\/p>\n<ul>\n<li>Smoking in the Vehicle: XCG 300<\/li>\n<li>Transporting animals without permission: XCG 300<\/li>\n<li>Loss of car keys: XCG 250<\/li>\n<li>Lock-out service: XCG 125<\/li>\n<li>Loss of vehicle documents: XCG 100<\/li>\n<li>Extreme contamination: XCG 300<\/li>\n<li>Excessive sand or salt contamination\/damage to the interior: actual reasonable repair costs.<\/li>\n<\/ul>\n<p>4. Charging a fixed amount does not affect the Lessor&#8217;s right to charge additional reasonable costs if the actual damage can be demonstrated to be higher and this is permitted by law.<\/p>\n<h2>Article 16 \u2013 Cleaning, Smoking, Animals and Contamination<\/h2>\n<p>1. The Lessee must return the Vehicle in a normal and reasonably clean condition.<\/p>\n<p>2. Smoking in the Vehicle is not permitted.<\/p>\n<p>3. Transporting animals is only permitted with the Lessor&#8217;s prior permission.<\/p>\n<p>4. Excessive contamination, strong odours, liquid damage, animal hair, mud, sand or salt residue may result in additional cleaning or repair costs.<\/p>\n<p>5. Normal signs of use that can reasonably be expected from normal use of a rental car shall not be considered damage.<\/p>\n<h2>Article 17 \u2013 Loss of Rental Income<\/h2>\n<p>1. If damage, loss or another event attributable to the Lessee results in the Vehicle temporarily being unavailable for rental, the Lessor may charge reasonable loss of rental income for the period during which the Vehicle is demonstrably unavailable.<\/p>\n<p>2. Loss of rental income shall only be charged insofar as it is directly related to the event and can reasonably be substantiated.<\/p>\n<h2>Article 18 \u2013 Personal Belongings<\/h2>\n<p>1. The Lessor is not liable for loss, theft or damage to personal belongings of the Lessee or passengers located in or around the Vehicle.<\/p>\n<p>2. The Lessee must not leave personal belongings unattended in the Vehicle.<\/p>\n<p>3. When returning the Vehicle, the Lessee must thoroughly check the Vehicle for any belongings left behind.<\/p>\n<h2>Article 19 \u2013 Transport Outside Cura\u00e7ao<\/h2>\n<p>1. The Vehicle may not be taken outside Cura\u00e7ao without the Lessor&#8217;s prior written permission.<\/p>\n<p>2. Transporting the Vehicle by boat, ship or aircraft to another island or country is not permitted without prior permission.<\/p>\n<p>3. If the Lessee takes the Vehicle outside Cura\u00e7ao without permission, the Lessee is liable for all resulting costs and damage, to the extent permitted by law.<\/p>\n<h2>Article 20 \u2013 Liability of the Lessor<\/h2>\n<p>1. The Lessor will make reasonable efforts to provide the Vehicle at the start of the Rental Period in a safe and properly maintained condition.<\/p>\n<p>2. To the extent permitted by law, the Lessor is not liable for damage resulting from the acts or omissions of the Lessee, Driver or third parties.<\/p>\n<p>3. The Lessor is not liable for loss or damage to personal belongings of the Lessee or passengers.<\/p>\n<p>4. The Lessor is not liable for indirect or consequential damage, to the extent such limitation of liability is permitted by law.<\/p>\n<p>5. The Lessor is not liable for delays, inconvenience or costs arising because the Lessee cannot use the Vehicle on time due to circumstances reasonably beyond the Lessor&#8217;s control.<\/p>\n<p>6. None of the provisions of this article is intended to exclude liability to the extent such exclusion is not permitted by law.<\/p>\n<h2>Article 21 \u2013 Force Majeure<\/h2>\n<p>1. The Lessor is not liable for a failure to perform resulting from circumstances over which the Lessor can reasonably exercise no control.<\/p>\n<p>2. Force majeure may include, among other things:<\/p>\n<ul>\n<li>natural disasters;<\/li>\n<li>extreme weather conditions;<\/li>\n<li>government measures;<\/li>\n<li>serious traffic or transport problems;<\/li>\n<li>strikes;<\/li>\n<li>disruptions involving third parties;<\/li>\n<li>sudden technical circumstances that could not reasonably have been prevented;<\/li>\n<li>other unforeseen circumstances outside the Lessor&#8217;s reasonable sphere of control.<\/li>\n<\/ul>\n<p>3. If, due to force majeure, the Rental Agreement cannot be performed or cannot be performed on time, the parties shall consult in good faith about an appropriate solution.<\/p>\n<h2>Article 22 \u2013 Cancellation and No-show<\/h2>\n<p>1. Cancellations must be communicated to the Lessor in writing or digitally.<\/p>\n<p>2. If the Lessee cancels no later than 48 hours before the start of the Rental Period, the reservation may be cancelled free of charge, unless different conditions are stated in the reservation confirmation.<\/p>\n<p>3. In the event of cancellation within 48 hours before the start of the Rental Period, the Lessor may charge cancellation fees in accordance with the reservation terms.<\/p>\n<p>4. If the Lessee does not appear at the agreed time and has not cancelled the reservation in time, this shall be considered a no-show.<\/p>\n<p>5. In the event of a no-show, the Lessor has no obligation to refund the Rental Price already paid, to the extent permitted by law and unless otherwise agreed in writing.<\/p>\n<p>6. If a flight is delayed, the Lessee must inform the Lessor as soon as possible. The Lessor will make reasonable efforts to take the changed arrival time into account. <\/p>\n<h2>Article 23 \u2013 Termination and Dissolution<\/h2>\n<p>1. The Lessor is entitled to terminate the Rental Agreement with immediate effect if the Lessee:<\/p>\n<ul>\n<li>seriously violates these terms and conditions;<\/li>\n<li>uses the Vehicle carelessly or unlawfully;<\/li>\n<li>has provided incorrect or misleading information;<\/li>\n<li>allows the Vehicle to be driven by an unauthorised Driver;<\/li>\n<li>fails to pay amounts due;<\/li>\n<li>endangers the safety of persons or property;<\/li>\n<li>fails to return the Vehicle on time;<\/li>\n<li>takes the Vehicle outside Cura\u00e7ao without permission.<\/li>\n<\/ul>\n<p>2. Upon termination, the Lessor may demand the immediate return of the Vehicle.<\/p>\n<p>3. The Lessee must immediately return the Vehicle to the location specified by the Lessor.<\/p>\n<p>4. If the Lessee does not voluntarily return the Vehicle, the Lessor may take the necessary steps to recover the Vehicle, to the extent permitted by law.<\/p>\n<p>5. Termination of the Rental Agreement does not affect the Lessee&#8217;s obligation to pay amounts already due and any damages.<\/p>\n<h2>Article 24 \u2013 Privacy and Personal Data<\/h2>\n<p>1. The Lessor processes personal data of the Lessee and Drivers insofar as necessary for, among other things:<\/p>\n<ul>\n<li>entering into and performing the Rental Agreement;<\/li>\n<li>identification;<\/li>\n<li>reservation and rental administration;<\/li>\n<li>payment administration;<\/li>\n<li>handling damage claims;<\/li>\n<li>compliance with legal obligations;<\/li>\n<li>communication with the Lessee.<\/li>\n<\/ul>\n<p>2. The Lessor will handle personal data carefully and will not retain it for longer than necessary or legally required.<\/p>\n<p>3. Where applicable, additional information about the processing of personal data is included in Grandi Car Rental&#8217;s privacy statement.<\/p>\n<h2>Article 25 \u2013 Amendments to the General Rental Terms and Conditions<\/h2>\n<p>1. The Lessor is entitled to amend these General Rental Terms and Conditions.<\/p>\n<p>2. Amended terms apply to new reservations made after the amendment.<\/p>\n<p>3. For Rental Agreements already concluded, the terms and conditions applicable at the time the relevant Rental Agreement was entered into shall in principle remain applicable, unless an amendment is necessary due to a legal obligation.<\/p>\n<h2>Article 26 \u2013 Severability<\/h2>\n<p>1. If one or more provisions of these General Rental Terms and Conditions prove to be invalid, void or unenforceable, the remaining provisions shall remain fully in force.<\/p>\n<p>2.
